Terms of Service

By accessing or using the IMARA PRMF contribution calculator ("Service"), you agree to these Terms of Service ("Terms").

These Terms govern your use of the calculator made available by the Imara Post-Retirement Medical Fund ("Imara PRMF", "we", "us", or "our").

If you do not agree to these Terms, you must not use the Service.

You must be at least 18 years old and have authority to use the Service.

The Service provides indicative contribution figures for the Imara Post-Retirement Medical Fund (PRMF).

The calculator uses your age, who is covered (member only, or member and spouse) and your chosen benefit plan to show the contribution certified by Kenbright Actuarial & Financial Services: monthly for ages 18–59, or a one-off lump sum for ages 60–80. Figures are indicative of what the fund's rules require and remain subject to the Imara PRMF Trust Deed and Rules.

Results are provided for information only and do not, by themselves, create a contract of insurance, confirm eligibility, or amend the Imara PRMF Trust Deed and Rules, any policy documents, or benefit approvals.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

- Use the Service for any illegal, fraudulent, or unauthorized purpose

- Attempt to gain unauthorized access to the application or underlying systems

- Interfere with, disrupt, or degrade the operation or security of the Service

- Upload or transmit malware, malicious code, or harmful content

- Use bots, scrapers, or other automated tools against the Service without written authorization

- Misrepresent your identity, authority, or affiliation with Imara PRMF

Violation of these rules may result in suspension of access or further action where appropriate.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, TO THE EXTENT PERMITTED BY LAW.

Indicative results only: calculator outputs are generated from the rates and inputs configured in the system at the time of use.

No binding commitment: a calculator result does not amount to enrollment, approval of benefits, confirmation of contributions by the fund or its administrator, or a guarantee that any rate will remain unchanged.

Input-dependent accuracy: inaccurate inputs, outdated information, or technical issues can affect the results displayed.

Operational availability: Imara PRMF may update, suspend, or withdraw the Service at any time for maintenance, correction, security, or administrative reasons.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IMARA PRMF SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM USE OF THE SERVICE.

- Loss arising from inaccurate user inputs or reliance on indicative calculator results as final decisions

- Loss caused by service interruptions, delays, or technical faults beyond Imara PRMF's reasonable control

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

You agree to indemnify and hold harmless Imara PRMF, and its officers, employees, and agents, from claims, losses, liabilities, or expenses arising from:

- Your misuse of the Service

- Your breach of these Terms

- Your violation of applicable law or the rights of another person in connection with your use of the Service

This obligation survives termination of your use of the Service to the extent permitted by law.

All content, features, software, text, graphics, and branding in the Service are owned by or licensed to Imara PRMF and are protected by applicable intellectual property laws.

Imara PRMF grants you a limited, revocable, non-transferable right to use the Service for lawful PRMF-related informational purposes.

You may not copy, modify, distribute, reverse engineer, republish, or create derivative works from the Service except where Imara PRMF has given written permission or where permitted by law.

The Imara PRMF name, logo, and related marks may not be used without prior written authorization from Imara PRMF.

Imara PRMF may amend these Terms from time to time to reflect operational, legal, security, or service changes.

When material updates are made, we will revise the "Last Updated" date and may provide additional notice through the Service where appropriate.

Your continued use of the Service after updated Terms take effect constitutes acceptance of the revised Terms.

If you do not agree to revised Terms, you must stop using the Service.

You may stop using the Service at any time.

Imara PRMF may suspend, restrict, or terminate access immediately where necessary for security, operational, legal, or policy reasons, including breach of these Terms.

On termination, your right to use the Service ends immediately.

Sections that by their nature should survive termination will continue to apply after access ends.

These Terms are governed by the laws of the Republic of Kenya.

Any dispute arising from or relating to these Terms or the Service should first be raised with Imara PRMF in good faith to allow internal review and resolution where possible.

Where a matter is not resolved amicably, it shall be handled in accordance with applicable Kenyan law and the jurisdiction of the competent courts or dispute-resolution forums in Kenya.

These Terms, together with the Privacy Policy, set out the full terms governing your use of the Service.

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

A failure by Imara PRMF to enforce a provision immediately does not waive the right to enforce it later.
